1. Brett Moreland, 160 Lyell Street, Spencerport, NY 14559, is here to report on his progress after receiving conditional approval on his appeal to extend his Special Use permit that was granted on December 6, 2018 and previously granted on May 7, 2015 and February 2, 2017. Tax Acct. #086.01-2-5.2

III. PUBLIC HEARING NEW BUSINESS: 

2. Appeal of Michael Freitas, 183 Whittier Road, Rochester, NY 14624, for an area variance on property located at same, to construct a 14’ addition to existing home for a new front setback of 48’, whereas, principal buildings shall be not less than 60 feet from the street right of way line, pursuant to Chapter 300-28 F (1) (d) in an R-1 Residential District. Tax Acct. #117-02-2-17 

3. Appeal of Manuel DasFaias, 91 Chambers Street, Spencerport, NY 14559, for an area variance on property located at same, to allow a 12’ addition to existing home which is 13’ from the side setback, whereas, principal buildings shall be not less than 15 feet from the side setback, pursuant to Chapter 300-28 F (1) (e) in an R-1 Residential District. Tax Acct. #101.04-4-9 

4. Appeal of Brian & Andrea Buxton, 68 Beau Lane, Rochester, NY, 14624, for two (2) area variances to install approximately 102 linear feet of 6’ high fence, which is 5’high, closed construction with 1’ open construction on top in the side and rear yard, whereas, fences shall not exceed four feet in height in side and rear yards and any fence in a residential district shall be of open and permanent construction, pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) respectively in an R-1 Residential District. Tax Acct. #131.02-4-48 

5. Appeal of Donald Gentle, 189 Ogden Parma Town Line Road, Spencerport, NY 14559, for three (3) area variances to install a 6’tall, solid construction fence located in the front, side and rear yards, at property located at same, whereas, fences shall not exceed three feet in the height in front yard, nor 4’ in height in side and rear yards, nor shall any fence be of closed construction; pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) respectively in a R-1 Residential District. Tax Acct. #087.02-2-1 

6. Appeal of Mark Crane of Mark’s Pizzeria, to obtain a Special Use Permit and one (1) area variance to install two (2) Mark’s Pizzeria signs, on property located at 4179 Buffalo Road, Rochester, NY 14624, whereas, each commercial enterprise shall be permitted to install said sign upon obtaining a permit by the Zoning Board of Appeals, pursuant to Chapter 224-8 A in a General Commercial District. Tax Acct. #132.01-3-17.1
