Village of Belgium Village Board met Dec. 9.

Here is the minutes provided by the board:

1. CALL TO ORDER AND SILENCE CELL PHONES

The meeting was called to order at 7:00 pm by Village President, Pete Anzia.

2. ROLL CALL OF OFFICERS

Trustees Present: Pete Anzia, Rose Sauers, Josh Borden, Don Gotcher, Clem Gottsacker, Victor Lecato, and Dan Wolff. Staff Present: DPW Superintendent Dan Birenbaum, Wastewater Superintendent Paul Bley, DPW employee Brian Schmidt, Treasurer Vickie Boehnlein, and Clerk Julie Lesar. Also in attendance: resident Bill Janeschek, residents Randy & Donna Ingelse, Stantec Consulting Services Michaela Zuelke and Melissa Curran, GRC & D Samantha Lammers, BACC Tara Williams, and Ozaukee Press Mitch Maersch.

3. OPEN MEETING LAW COMPLIANCE CHECK

This meeting is in compliance with the Open Meetings Law of the State of Wisconsin.

4. PLEDGE OF ALLEGIANCE AND A MOMENT OF SILENCE

All in attendance stood for the Pledge of Allegiance and a moment of silence.

5. PUBLIC INPUT

There was no public input.

6. BELGIUM AREA CHAMBER OF COMMERCE REPORT

6.a. Tara Williams, BACC Executive Director provided a recap of the Belgium European Christmas Parade and Market. The next event is the Brew & Chew scheduled for February 1, 2020 at Memories Ballroom.

7.a. Approve Minutes from Village Board and Ad Hoc Committee meetings Moved by Pete Anzia, seconded by Clem Gottsacker, to approve meeting minutes. MOTION CARRIED by the following votes:

7.b. Monthly Board Reports

Moved by Don Gotcher, seconded by Rose Sauers, to accept monthly board reports. MOTION CARRIED by the following votes:

9. NEW BUSINESS - CONSIDERATION, DISCUSSION & POSSIBLE ACTION

REGARDING:

9.a. Presentation from Glacierland Resource Conservation & Development Council (GRC&D): Michaela Zuelke and Melissa Curran from Stanec Consulting Services and Samantha Lammers from GRC&D provided information regarding a DNR funded project to control invasive grass, Phragmites on public and private lands across Ozaukee County. They are asking for assistance from the Village to communicate the purpose of this project in order to control this invasive grass.

9.b. Approve recommendation of Plan Commission to approve Land Division Application for property located at 1000 Main Street tax key #18-050-01-02-000 

Moved by Clem Gottsacker, seconded by Rose Sauers, to approve requested land division.

9.c. Approve recommendation of Plan Commission to approve zoning district change of Lot 2, 1000 Main Street to B-1 contingent upon minor land division.

Moved by Clem Gottsacker, seconded by Rose Sauers, to approve Ordinance 17-19 to rezone the west portion of the property known as 1000 Main Street to B-1 Business District.

9.d. Approve Ordinance 21-19 amending §§104-2 and 104-3 of the Village Code - State Uniform Dwelling Code and State Building, Plumbing and Electrical Codes.

Moved by Rose Sauers, seconded by Josh Borden, to approve ordinance 21-19 amending §§104-2 and 104-3 of the Village code. MOTION CARRIED by the following votes:

9.e. Annual Approval to write off inactive utility accounts with credit balances per PSC recommendations: Clem Gottsacker made motion to approve writing off inactive utility account with credit balances. Motion was seconded by Don Gotcher. Treasurer Vickie Boehnlein pointed out that the write-off policy applies to accounts with outstanding total balance under $20. No vote was taken.

Moved by Rose Sauers, seconded by Don Gotcher, to amend the motion to approve writing off inactive utility accounts with delinquent balances. MOTION CARRIED by the following votes:

Ayes: Clem Gottsacker, Don Gotcher, Dan Wolff, Josh Borden, Pete Anzia, Rose Sauers, and Victor Lecato

9.f. Approve recommendation of Finance & Personnel Committee to not make proposed changes to Short Term Disability Benefit as outlined in Appendix B of revised Employee Handbook. Appendix B is Village Policy that was approved by Village Board 01-13-2014. Finance and Personnel reviewed this policy at their November 20, 2019 meeting. Josh Borden made a motion to approve not making changes to Short Term Disability Benefit as outlined in Appendix B. Motion was seconded by Rose Sauers. Boehnlein stated that the current policy does not clearly define employees' weekly earnings. There was confusion as to what changes to the policy should be approved. It was recommended to refer the discussion back to committee. Borden withdrew his motion.

Moved by Josh Borden, seconded by Rose Sauers, to refer this item back to Finance & Personnel Committee for further review.

9.g. Approve Finance & Personnel Committee recommendation to approve revised Village Employee Handbook.

Moved by Clem Gottsacker, seconded by Rose Sauers, to approve revised Village Employee Handbook.

9.h. Approve Finance & Personnel Committee recommendation that the Village cover the embroidery setup costs and the cost of one apparel item for all full time employees from the list provided. Apparel may also be made available to Village Trustees and the public to purchase.

Moved by Josh Borden, seconded by Don Gotcher, to approve Village cover embroidery setup costs and the cost of one apparel item for all full time employees from the list provided. Borden amended his motion to limit the cost to $35 for any, one apparel item of choice for all full time Village employees. MOTION CARRIED by the following votes:

Ayes: Clem Gottsacker, Dan Wolff, Don Gotcher, Josh Borden, Pete Anzia, Rose Sauers, and Victor Lecato

9.i. Approve Ordinance 22-19 as recommended by Finance & Personnel to make the following changes:

- to replace "Village Clerk" with "Village Treasurer" in Village Ordinance §35-9

- to remove the following statement: "A copy of the Wisconsin sales tax return shall be attached to the Village return." from Village Ordinance § 35-16.C

- to update Village Ordinance § 35-17 to state "a charge of 1% per month" rather than "a charge of 1 1/2% per month".

Moved by Josh Borden, seconded by Clem Gottsacker, to approve ordinance 22-19 to amend §§35-9, §35-16.C, and §35-17 as stated. MOTION CARRIED by the following votes:

9.j. Approve list of elections inspectors for 2020-21 term.

9.k. Approve Operator License for Mary Shapaker.

9.l. Approve recommendation from Ad Hoc Committee meeting, December 2 to form an exploratory committee for Silver Beach Road. Members to be approved by the Village Board. Pete Anzia made a recommendation to hold off on forming a committee at this time. He would like to have the full Village Board meet with the Town Board to discuss this project before forming a committee.

Moved by Don Gotcher, seconded by Clem Gottsacker, to approve Village to create Silver Beach Road Ad Hoc Committee.

9.m. Discuss, make recommendation, or approve adjustment to Treasurer's wage/salary to comply with US Dept of Labor Fair Labor Standards Act minimum wage & overtime pay requirements. Vickie Boehnlein explained that a change in the Fair Labor Standards Act will take effect on January 1rst, 2020. This change sets a minimum threshold for salaried employees at $35,568. The Village Treasurer is the only salaried employee earning below this threshold. The Village must either change the Treasurer to hourly and pay over time or increase the salary ($194.40) to meet the $35,568 threshold. Boehnlein verified that meeting pay would not count towards the salary total.

Moved by Rose Sauers, seconded by Don Gotcher, to adjust the Treasurer's salary to comply with US Dept of Labor Fair Labor Standards Act starting January 1, 2020. Sauers amended her motion to adjust the Treasurer's salary to the minimum $35,568. MOTION CARRIED by the following votes:

Ayes: Clem Gottsacker, Dan Wolff, Don Gotcher, Josh Borden, Pete Anzia, Rose Sauers, and Victor Lecato

9.n. Review and approve ambulance service contract with the Fredonia Fire Department. Moved by Pete Anzia, seconded by Don Gotcher, to approve Ambulance Service Contract with Village of Fredonia Fire Department paying an annual cost of $18,000 starting January 1, 2020 to December 31, 2022.

9.o. Approve revised Residential Curbside Garbage Collection Billing Policy
