Here is the agenda provided by the board:

The following Public Hearing will be held by the Zoning Board on Thursday, October 1, 2020 at 7:00pm to consider the following applications:

NEW BUSINESS:

1. Appeal of Tyler Hopkins 21 Golden Pond Trail, Spencerport, NY 14559 for two (2) area variances, on property located at same, to install a 6’ tall, closed construction privacy fence, whereas, fences shall not exceed four feet in height in side and rear yards, and whereas, any fence in a residential district be of open and permanent construction, respectively pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) in an R-1 Residential District. Tax Acct. #087.02-3-18

2. Appeal of Richard and Beth Greer 385 Hubbell Road, Spencerport, NY 14559 for a conditional use permit and two (2) area variances, on property located at same, to erect a 788 sqft in-law apartment within the minimum front setback, whereas, a conditional use permit is required from the Zoning Board of Appeals, and whereas, in-law apartments shall not exceed 750 sqft, and whereas, the minimum front yard setback is 60 feet, respectively pursuant to Chapter 300-28 D and Chapter 300-28 D (9) (a) and Chapter 300-28 F (1) (d) in an R-1 Residential District. Tax Acct. #100.03-2-10

3. Appeal of Alvin Metcalf 67 Clearview Drive, Spencerport, NY 14559 to install a 40’ tall Ham Radio Tower, on property located at same, whereas, this shall be allowed with Zoning Board of Appeals approval, and for one (1) area variance to install a carport measuring 12’ x 26’ equaling 312sqft, with an existing shed 8’x12’ creating 408sqft of total accessory structure, whereas, the maximum square feet allowed for an accessory structure is 1%, which on this parcel equals 226 square feet, respectively pursuant to Chapter 273-8 and Chapter 300-28 F (3) (b) in an R-1 Residential District. Tax Acct. #086.08-3-8

4. Appeal of Adam Grinnell 32 Meadow Drive, Spencerport, NY 14559 for one (1) area variance, on property located at same, to construct an addition with a side setback of 9.9 feet, whereas, the minimum side setback for a principal building is 15 feet, pursuant to Chapter 300-28 F (1) (e) in an R-1 Residential District. Tax Acct. #071.20-1-27

5. Appeal of Donald and Dana Lindsay, 60 Beau Lane, Rochester, NY 14624 for a Conditional Use permit and one (1) area variance. The Conditional Use permit for an in-law apartment, on property located at same, whereas, this is permitted subject to the issuance of a conditional use permit by the Zoning Board of Appeals, and an area variance to construct a 12’ x 22’ third car garage, with a side setback of 6.9 feet, whereas, the minimum side setback on this lot is 10 feet, due to a previous 278, respectively pursuant to Chapter 300-28 D (9) and Chapter 300-28 F (1) (e) in an R-1 Residential District. Tax Acct. #131.02-4-46

6. Appeal of Jason Eve 2844 Union Street, Rochester, NY 14624 for a special use permit renewal to operate an in-home business of deer processing from October 15th through December 30th, on property located at same, whereas, this is an in-home occupation that may be allowed with a home occupation permit granted

by the Zoning Board of Appeals, pursuant to Chapter 300-54 in an R-1 Residential District. Tax Acct. #116.04-2-7

7. Appeal of Anthony Bellone 1080 Washington Street, Spencerport, NY 14559 for two (2) area variance, on property located at same, to construct a 6’ tall by 50 linear feet of closed construction fence, whereas, any fence in a residential district shall not exceed four feet in height in side and rear yards and be of open and permanent construction, respectively pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) in an R-1 Residential District. Tax Acct. #115.02-2-13

8. Appeal of David and Joan Moore 5 Wanakena Trail, Spencerport, NY 14559 for one (1) area variance, on property located as same, to construct a garage addition with a front setback of 38’10”, whereas, the minimum front yard setback is 60 feet, pursuant to Chapter 300-28 F (1) (d) in an R-1 Residential District. Tax Acct. #087.04-3-6

9. Appeal of Lifetime Assistance Inc 58 Beaman Road, Rochester, NY 14624 for two (2) area variances, on property located at same, to construct 65 linear feet of 6’ tall, closed construction fence, whereas, fences shall not exceed four feet in height in side and rear yards, and whereas, any fence in a residential district shall be of open and permanent construction, respectively pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) in an R-1 Residential District. Tax Acct. #132.02-3-39.1

10. Appeal of Emerald Point Developers, LLC 111 Whittier Road, Rochester, NY 14624 for five (5) area variances, on property located at same, to construct a 24’ tall, two story accessory structure; to construct four (26 unit) three story, apartment buildings, 49’ tall; and to construct nine (10 unit) apartment buildings, whereas, accessory structures shall not exceed 15’ in height or one story; and whereas, no apartment house shall be over two and a half stories or 35’ in height; and whereas, no apartment building shall contain more than eight dwelling units, respectively pursuant to Chapter 300-30 C (1) (a) and Chapter 300-30 C (1) (b) in a MFR Multiple-Family Residential District. Tax Acct. # 117.04-3-4.111
