The Ogden Zoning Board of Appeals was called to order at 7:00 PM.

1. Appeal of Ronald & Terry Scarpulla, 675 Whittier Road, Spencerport, NY 14559, for two (2) area variances, on property located at same, to construct a 26’ x 36’ x 21’ high (936 sq. ft.) accessory building in addition to an existing accessory building of 96 sq. ft. for a total of 1,032 sq. ft., whereas, no accessory building(s) may exceed 600 square feet total floor area per parcel, regardless of lot size, and whereas, no accessory structures of 121 square feet or greater shall not exceed 15 feet height, respectively pursuant to Chapter 300-28 F (3) (b) and Chapter 300-59 B (1) in a R-1 Residential District. Tax Acct. #115.02-1-16.21

PLEASE TAKE NOTICE that at a meeting of the Ogden Zoning Board of Appeals held on February 6, 2020, the appeal was granted Approval with the following conditions:

• That the accessory structure be constructed and installed to professional standards and is to be well maintained;

• That the accessory structure not be used for commercial activity;

• That any exterior lighting be limited to motion sensored, no dusk to dawn or mercury vapor lighting;

• That a building permit be obtained from the Building Department prior to commencing construction.

Appeal of Michael VanGemert, 15 Ashland Oaks Circle, Spencerport, NY 14559, for an area variance, on property located at same, to construct a 22’ x 20’ (440 sq. ft.) garage addition to the existing garage of 735 sq. ft. for a total of 1,175 sq. ft., whereas, single family residences are allowed garage space for not more than three (3) motor vehicles (maximum square footage of garage space per lot not to exceed 960 square feet), pursuant to Chapter 300-28 C (2) in a R-1 Residential District. Tax Acct. # 087.01-5-4

One (1) variance to construct a 1253 sq. ft. attached garage, whereas, single family residences are allowed garage space for not more than three (3) motor vehicles (maximum square footage of garage space per lot not to exceed 960 square feet). And two (2) area variances to construct an 8,460 sq. ft. pole barn with a height of 29’6”, whereas, no accessory building(s) may exceed 600 square feet total floor area per parcel, regardless of lot size, and whereas, no accessory structures of 121 feet or greater shall not exceed 15 feet height, respectively pursuant to Chapter 300-28 C (2), Chapter 300-28 F (3) (b) and Chapter 300-59 B (1) in a R-1 Residential District. Tax Acct. #117.02-2-15
