WHEREAS, a vacancy in office occurred when Scott Clyde tendered his resignation as Councilman of the Town of Ogden; and

WHEREAS, pursuant to §64 of the Town Law, the authority to fill such vacancy is delegated to the Town Board; and

WHEREAS, Aaron Baker is a resident of the Town of Ogden and is otherwise qualified to be appointed to fill such vacancy in office;

NOW, THEREFORE, be it resolved by the Town Board of the Town of Ogden, Monroe County, New York, as follows:

SECTION I: The Town Board of the Town of Ogden, by the adoption of this Resolution, does appoint Aaron Baker as Councilman of the Town of Ogden, and upon his taking his Oath of Office he shall serve in such position for the remainder of the unexpired term of Scott Clyde.

SECTION II: That the Town Clerk shall notify the Monroe County Board of Elections of this appointment.

WHEREAS, Aaron Baker has submitted his resignation from the Town of Ogden Zoning Board of Appeals, and

WHEREAS, this resignation will be effective March 6, 2020.

SECTION I: That the Town Board of the Town of Ogden does hereby accept, with regret, the resignation of Aaron Baker effective March 6, 2020.

WHEREAS, there is a vacancy on the Zoning Board of Appeals due to the resignation of Aaron Baker and;

WHEREAS, interviews were conducted with qualified candidates and John Crooks Jr was found to be qualified and desirous of the position.

NOW, THEREFORE BE IT RESOLVED:

SECTION I: That the Town Board of the Town of Ogden does hereby appoint John Crooks Jr as a member of the Ogden Zoning Board of Appeals and said appointment shall become effective March 16, 2020 with term to expire on December 31, 2024.

WHEREAS, the Town of Ogden has determined that the following items owned by the Town of Ogden are no longer suitable or needed for municipal purposes:

WHEREAS, pursuant to the provision of Town Law, the Town Board of the Town of Ogden may dispose of property no longer needed for public purpose;

NOW, THEREFORE BE IT RESOLVED that by adoption of this resolution, the Town Board of the Town of Ogden does hereby declare the above items as surplus and authorize the Highway Department to dispose of the above listed property by public or private sale.

RESOLUTION AND NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE LOCAL LAW #2-2020

WHEREAS, the Town Board of the Town of Ogden previously proposed to enact Local Law No. 2 of the year 2020 which local law proposed to amend §300-82(c) to add “Utility Trailer” to the list of regulated items, and to provide that up to 2 (two) such vehicles per family may be parked or stored on any lot containing the dwelling unit of such family; and

WHEREAS, prior to the enactment of such local law, the Town Board must determine the environmental significance, if any, of the proposed action; and

WHEREAS, upon a review of Type II Actions, Actions deemed not to have any significant adverse environmental impact, it appears that “routine or continuing agency administration and management” are listed Type II Actions, and are actions deemed not to have any significant effect upon the environment;

NOW, THEREFORE, be it resolved by the Town Board of the Town of Ogden, Monroe County, New York, as follows:

SECTION I: That by the adoption of this Resolution the Town Board does Find and Determine that the proposed adoption of Local Law #2 of the year of 2020, is a Type II Action, an action deemed not to have any adverse environmental impacts.

SECTION II: That the enactment of Introductory Local Law #1 of the year 2020 may proceed without further regard to the provisions of SEQR.

INTRODUCTORY LOCAL LAW # 2-2020

WHEREAS, the Town Board of the Town of Ogden did heretofore advertise and conduct a Public Hearing to consider the enactment of Introductory Local Law #2- 2020, which Local Law proposed to amend §300-82(c) to add “Utility Trailer” to the list of regulated items, and to provide that up to 2 (two) such vehicles per family may be parked or stored on any lot containing the dwelling unit of such family; and

WHEREAS, such Public Hearing was duly held and conducted by the Town Board of the Town of Ogden on the 11th day of March, 2020 and at which hearing, all interested persons were heard concerning the subject matter thereof; and

NOW, THEREFORE, be it resolved by the Town Board of the Town of Ogden, Monroe County, New York, as follows:

SECTION I: That by the adoption of this Resolution, the Town Board does hereby enact Introductory Local Law #2-2020, which Local Law reads and provides as follows:

Amend §300-82 (c) to read and provide as follows:

C. A camper, camper trailer, utility trailer, mobile home or house trailer having an overall length of 35 feet or less may be parked on public property and may be parked or stored outside on private property, subject to the following regulations:

Only two such vehicles per family may be parked or stored on any lot containing the dwelling unit of such family. The foregoing notwithstanding, there shall be no restriction on the number of such vehicles parked or stored within an enclosed garage.

SECTION II: That the Town Clerk shall file this Local Law with the Secretary of State as required by law.

Section II. Amend §300-32(D) Neighborhood Commercial to add §300- 32(D)(7) Nursery School/Day Care Center/ Child Care Center

Section III. Amend §300-33(D) General Commercial District to add §300- 33(D)(10) Nursery School/Day Care Center/ Child Care Center

SECTION II: That the Town Clerk shall file this Local Law with the Secretary of State as required by law.
