Daniel G. Schum, Town Attorney

1. Working with Borrego Solar on the letter of credit for the landscaping and what not. I am working with Emily. I am hopeful we will get that. The decommissioning agreement were approved last meeting and signed and I delivered originals to Noelle and Patrick.

Supervisor Lenhard: How far will they be going before it’s in the ground?

Dan Schum: Well I was talking to another gentleman who does drilling and he is so backed up with the solar company because he just drills holes so they can put the posts in and once they put the posts in they bolt it on and it’s ready to go. A lot of the solar sites have very little ground and a lot of rock so he has been backed up. I don’t know their contract times. Patrick have they been talking about getting a permit?

Patrick Smith: They have already dropped off all the applications and plans for the permits but I can’t even look at them until I get the decommissioning money and the letter of credit for storm water. We are still waiting on that. Their engineer is supposed to confirm it with John Freel but we don’t have a number yet. They are close so as soon as they get that they will want a permit right away.

Councilman Feeney: Is there any way to stop this Dan?

Dan Schum: No. If they don’t put up the money then they will never get a building permit.

Patrick Smith: The letter of credit for the decommissioning amount I think is $800,000. We will keep that until the day it is taken down. Delaware River has been drilling holes and the funny thing is I took the Supervisor to look at it one day and when they drill a hole there is no dirt that comes out of the hole it is all rock. The bedrock is close and they’ve hit a wet spot on the south side of the property and they want permission to do a different kind of foundation and I said well we have gone through this before you go to the Planning Board and ask permission. So they are going to have to drill a bigger hole and put concrete in or whatever otherwise they won’t have the right uplift force to keep it from blowing out of the ground. They will be coming back to the Planning Board to update that section and put some kind of other foundation in.

Supervisor Lenhard: Is there any reason not to give them permission?

Patrick Smith: No but it is a change. If we allow them to do something different than what the plan shows it is better for us to make them go to the Planning Board and get permission.
