The Ogden Zoning Board of Appeals was called to order at 7:00 PM.

I. PLEDGE OF ALLEGIANCE

Ms. Cordts mentioned all emergency exits and general procedures.

II. OLD BUSINESS:

1. Appeal of Steve Randazzo of Mangia Mangia, for a special permit and one (1) area variance to install a 108 square foot post mounted commercial sign, on property located at 2273 Union Street, Spencerport, NY 14559, whereas, each separate commercial enterprise shall be permitted to erect, upon obtaining a permit from the Zoning Board of Appeals, one or more signs mounted or placed on the front of a building not more than 16 square feet if post mounted, pursuant to Chapter 224-8 A in a Restricted Business District. Tax Acct. #101.02-1-22.11

Resolution #1

PLEASE TAKE NOTICE that at a meeting of the Ogden Zoning Board of Appeals held on October 3, 2019, was granted approval with the following conditions:

1. That the 6’ x 6’ sign be constructed and installed to professional standards and is to be well maintained;

2. That a building permit be obtained from the Building Department prior to commencing construction

3. That the Special Sign permit shall be valid for a period of two (2) years;

4. That a photograph of the erected sign(s) be submitted to the Building Department after installation.

2. Appeal of Paul & Tracy Ferranti, 44 Clearview Drive, Spencerport, NY 14559, to appeal the decision of the Building Inspector’s revocation of the previous Zoning Board approval. Such appeal may be taken by any person wishing to appeal any order, requirement, decision or determination made by an administrative official and may apply for a hearing before the Zoning Board of Appeals. This, pursuant to Chapter 300-108 of the Code of the Town of Ogden. Tax Acct #086.08-2-29

3. Appeal of Debra Seniawski, 39 Quail Lane, Rochester, NY, 14624, for one (1) area variance to install approximately 120 linear feet of 5’ high, open construction fence, whereas, fences shall not exceed four feet in height in side and rear yards, pursuant to Chapter 300-50 A (8) (a) in an R-1 Residential District. Tax Acct. #117.04-8-6

PLEASE TAKE NOTICE that at a meeting of the Ogden Zoning Board of Appeals held on April 4, 2019, the appeal was granted Approval with the following conditions:

 That the fence will be 5’ high and open construction;

 That the fence be constructed and installed to professional standards and is to be well maintained;

 That a building permit be obtained from the Building Department.

Appeal of Chris Beiter, 5 Golden Pond Trail, Spencerport, NY, 14559 for two (2) area variances to install approximately 200 linear feet of 6’ high, closed construction fence in the rear yard, whereas, fences shall not exceed four feet in height in the rear yard and any fence in a residential district shall be of open construction, pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) respectively in an R-1 Residential District. Tax Acct. #087.02-3-22

PLEASE TAKE NOTICE that at a meeting of the Ogden Zoning Board of Appeals held on October 3, 2019, the appeal was granted Approval with the following conditions:

 That the fence will be six (6) feet high total with five (5) feet of solid construction and the top one (1) foot open construction;

 That the fence be constructed and installed to professional standards and is to be well maintained;

 That a building permit be obtained from the Building Department.

Appeal of Marie Laveck, 9 Clearview Drive, Spencerport, NY 14559, for an area variance, on property located at same, to construct front porch with a front setback of 54 feet, whereas, principal buildings shall be not less than 60 feet from the front setback, pursuant to Chapter 300- 28 F (1) (d) in an R-1 Residential District. Tax Acct. #087.05-3-10

PLEASE TAKE NOTICE that at a meeting of the Ogden Zoning Board of Appeals held on October 3, 2019, the appeal was granted Approval with the following conditions:

 That the porch be constructed and installed to professional standards and is to be well maintained;

 That the exterior of the addition mirror the existing structure;

 That a building permit be obtained from the Building Department.
