VII. Reports From Town Officers:

Gay H. Lenhard, Supervisor

1. We had our Biometrics yesterday, there are five women on that committee and they put it together so wonderfully. We had a different vendor than we had before and learned a lot about our bodies and ourselves. I thought it was excellent! We are blessed to have these five women who worked so hard on this.

2. I had visit from the Red Cross. I gave Dan and Chief Mears the paperwork connected with that. I was little concerned with what was expected of us and I just want to be sure that there are no loopholes in there. We don’t have a generator, we don’t have the kind of things that you would need in the event of a disaster. When we do get a generator it will make a big difference.

3. We are still attempting to get information on Governor Cuomo’s attempt to share more services and find a way to cut more money out of our budget. Our Finance Director and I have been talking about what more we can take out. We do believe that our residents want the services that we offer and at budget time we hardly ever have anyone come to the budget meetings so I don’t think that they are upset with us in any way but I just found out that the County Executive is going to try to get all the Supervisors and Mayors together to talk. It doesn’t hurt to see what everyone has to offer. We just did it a few years ago to freeze the taxes, we told them what could do to be more efficient.

1. I just wanted to thank the Board for allowing me to attend a NYS Town

Clerk’s Association meeting and it was very helpful.

Daniel G. Schum, Town Attorney

1. We have a couple things to go over in Work Session tonight, I dealt with Ellicott Development, I’ve got their S.W.P.P.P Agreement signed and recorded in the County Clerk’s office, furnished a copy to Keith O’Toole, still have not seen the balance of the petition for the extension of the sewer district. I don’t know where they are with that. It was given to them some time ago to do this item. I know they were anxious to get building permits and do all kinds of things but we needed to have the sewer district extension formed and I have not seen the petition. 2. There is a resolution tonight to adopt Local Law #4-2017 regarding stop signs and speeding limits in the town.

Whereas, there is a need for seasonal help in the Buildings and Grounds Department (Parks);

Now, Therefore Be It Resolved that the Town Board of the Town of Ogden does hereby approve hiring Rory Morris as a Seasonal (Parks) Laborer at the hourly rate of $11.50 effective April 24, 2017.

Resolved, that the Supervisor be and hereby is authorized to sign agreements as recommended by the Parks and Recreation Director, between the Town of Ogden and the Spencerport Soccer Club, Spencerport Junior Baseball, Ogden Bears Football and Spencerport Youth Lacrosse.

Resolution Introductory Local Law #4-2017

WHEREAS, the Town Board of the Town of Ogden did heretofore hold a Public Hearing to consider the enactment of Introductory Local Law #4- 2017, at which Hearing all interested persons were heard concerning the subject matter thereof; and

Whereas, after due deliberation the Town Board of the Town of Ogden desires to enact such Local Law;

Now, Therefore Be It Resolved by the Town Board of the Town of Ogden, Monroe County, New York, as follows:

Patrick Smith, Building Inspector: I have Mr. Fintak here regarding a fallen barn on his property. We are not going to have a public hearing but he needed to speak.

Dan Schum, Town Attorney: I was asked by the Building Department to look at the requirements for what to do with a barn as you can see in the picture that it was in substantial disrepair and initially it was my thought that we needed to have a public hearing with the owners to declare it to be an unsafe structure before Patrick could post it for No Occupancy but looking at the code it says that it can be posted for No Occupancy if it is not a single family residential structure. We have to have a hearing if it is. Since it is not a single family structure it is up to Code Enforcement Officer to declare it an unsafe structure. To my knowledge one of the owner’s is here tonight.

Patrick Smith, Building Inspector: There is actually two owners’ from what I understand. They both inherited it, one of which is Mr. Fintak’s wife and her brother which I believe. I and Mr. Fintak deemed it to be in danger of collapse. Joe Muniz drove by today and saw the neighbors out with kids playing in the driveway and decided to ask permission to talk to them. They say they see people every day going in and out of that building. Mr. Fintak has told us that people steal stuff so I believe that is very dangerous. We need to do something quickly so I invited Mr. Fintak to come and speak to the board about his plans.

Councilman Perry: What is the address?

Patrick Smith, Building Inspector: There is no address but it is between our park on Canal Road and Trimmer Road.

Councilman Perry: Oh ok, there was a fire there some time ago.

Patrick Smith, Building Inspector: Yes, that is correct.

Gary Fintak: This is all new to me. We inherited this so we want to do it correct with regards to the situation. We had it sold when my Mother-in-Law passed away, someone put a purchase offer in and they bailed out. This was when I first got involved with the family. It was around the same time housing went down and we couldn’t sell it at the time. Right now it is up for sale, we have people who are interested in it. We are negotiating and since then, this happened. I have a metal roof put on it because of all the rain and things. We are in the talks, one individual said he would like the barn. He works in construction and is willing to take it as is.

Dan Schum, Town Attorney: The issue becomes that the Building Department, whether or not it is used for storage of construction equipment or something else, it needs to be a safe structure and whoever buys it needs to be on notice that they need to present engineering drawings sufficient to satisfy the Town Engineer and the Building Department that whatever repairs they propose to make to it are going to be sufficient to make it a sound structure otherwise you, your wife and her brother are going to be subject to fixing it. The Town needs to move forward to protect the citizens so we need to post the property for No Occupancy and we need a plan from someone to either rehabilitate or to remove.

Gary Fintak: Well I had a meeting with Mr. Smith and Mr. Widger in regards to things and actions that need to happen and as far as today there is a dumpster sitting in front of the place because there are things that need to get out. I have a fence ready to be put up as well. I am going to go inside to assess the situation and clean it up. In the meantime we are still negotiating a sale.

Dan Schum, Town Attorney: As long as the Highway Department is satisfied, I think that a timetable to come up with a plan is reasonable. If there is nothing done within a certain amount of time we will talk again, is that fair?

Gary Fintak: Yes.
