Illinois Public Act mandates advance notice for municipal pesticide applications

The Illinois Department of Agriculture has implemented Illinois Public Act 103-0976, effective January 1, 2025. This legislation regulates pesticide use in municipalities, requiring at least 24 hours of public notice before pesticide application on public rights of way within municipal boundaries.

The required notice must detail the location and date of intended applications, the name and type of pesticide to be used, the reason for its use, concentrations, any special instructions, and contact information for both the applicator and the Illinois Department of Agriculture. Notices must be written and posted at least 24 hours prior to application. Acceptable posting mediums include newsletters, websites, calendars, or other official government publications.

Currently, there is no specific notification template mandated by the act. The City of Champaign will comply by issuing a monthly information notice covering city-wide pesticide applications by its employees and contractors. These notices will be accessible on the city's website and shared through social media platforms. Additional notifications may be issued for specific areas if necessary.
