1. Appeal of Jorge Sierra, 9 Beau Lane, Rochester, NY 14624 for a Conditional Use permit and for one (1) area variance. The Conditional Use permit for an in-law apartment, on property located at same, whereas, this is permitted subject to the issuance of a conditional use permit by the Zoning Board of Appeals, and an area variance for 806 square feet, whereas, square footage not to exceed 750 square feet, pursuant to Chapter 300-28 D (9) and Chapter 300-28 D (9) (a)respectively in an R-1 Residential District. 2. Appeal of Patrick Ford, 440 Ogden Sweden Townline Road, Spencerport, NY 14459, for two (2) area variances, on property located at same, to construct a 30’ x 40’ (1,200 sq. ft.) x 18 feet in height accessory structure whereas, no accessory structures may exceed 600 square feet total floor area per parcel, regardless of lot size, and no accessory structures of 121 square feet or greater shall not exceed 15 feet height, respectively pursuant to Chapter 300-28 F (3) (b) and Chapter 300-59 B (1) in a R-1 Residential District. NEW BUSINESS:

1. Appeal of Patrick Ford, 440 Ogden Sweden Townline Road, Spencerport, NY 14459, for an area variance, on property located at same, to construct a 36’ x 52’ (1,872 sq. ft.) accessory structure whereas, no accessory structures may exceed 600 square feet total floor area per parcel, regardless of lot size, pursuant to Chapter 300-28 F (3) (b) in a R-1 Residential District. Tax Account # 100.03-1- 1.1

2. Appeal of Roberts Wesleyan College, 2280 Westside Drive, Rochester, NY 14624 for one (1) conditional use permit and two (2) area variances on property located at same, to construct a Community Center with a front setback of 50’ and a side setback of 30’ whereas minimum setbacks for non-residential uses are 125 feet front setback and 50 feet side setback, pursuant to Chapter 300-28 F (2) (d) and Chapter 300-28 F (2) (e) respectively in an R-1 Residential District. Tax Acct. # 132.01-2-59.31

3. Appeal of Joseph Oliver, 4810 Lyell Road, Spencerport, NY 14559 for two (2) area variances, on property located at same to install 48 linear feet of 6’ tall, closed construction fence, whereas, fences shall not exceed four feet in height in side and rear yards and any fence in a residential district shall be of open and permanent construction, pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) respectively in an R-1 Residential District. Tax Acct. #102.04-1-51

4. Appeal of Tiffany Fink, 3330 Brockport Spencerport Road, Spencerport, NY 14559 for two (2) area variances, on property located at same, to install 224 linear feet of 6’ tall, closed construction fence, whereas, fences shall not exceed four feet in height in side and rear yards and any fence in a residential district shall be of open and permanent construction, pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) respectively in an R-1 Residential District. 5. Appeal of John Urlaub and Rohrbach Inc., 3859 Buffalo Road, Rochester, NY 14624 for one (1) area variance, on property located at same, to construct a 50 x 30 pole barn, 15 feet from the side property line whereas the minimum side setback of 30 feet, pursuant to Chapter 300-34 J (5) in a Light Industrial District. Tax Acct # 132.02-2-6

6. Appeal of Lukas M. Curley, 51 Stony Point Road, Rochester, NY 14624 to obtain a Home Occupation Permit to operate an in-home occupation to buy/sell firearms as a licensed Federal Firearms Dealer, at property located at same, whereas, this is allowed with a permit granted by the Zoning Board of Appeals, pursuant to Chapter 300-54, in an R-1 Residential District. Tax Acct. #132.01-2-17.

7. Appeal of Anthony Chiappone, 17 Meadow Drive, Spencerport, NY 14559 for two (2) area variances, on property located at same to install a 6’ tall, closed construction fence, whereas, fences shall not exceed four feet in height in side and rear yards and any fence in a residential district shall be of open and permanent construction, pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) respectively in an R-1 Residential District. Tax Acct. #087.05-1-4

8. Appeal of David and Nancy Anderson, 222 Whittier Road, Rochester, NY 14624 for one (1) area variance, on property located at the same, to install a 12’ x 20’ shed (240 sq. ft.), whereas, the maximum square feet allowed for an accessory structure is 1%, which on this parcel equals 153 square feet, pursuant to Chapter 300-28 F (3) (b) in an R-1 Residential District. Tax Account # 177.04-1-1

9. Appeal of Matthew and Tiffany Marialke, 4 Brewerton Drive, Rochester, NY 14624 for one (1) area variance, on property located at the same, to install a 12’ x 20’ shed (240 sq. ft.), whereas, the maximum sq. ft. allowed for an accessory structure is 1%, which on this parcel equals 127 square feet, pursuant to Chapter 300-28 F (3) (b) in an R-1 Residential District. Tax Account # 132.01-1-10

10. Appeal of Bruno & Maria Morabito, 26 Knollwood Drive, Churchville, NY 14428 for two (2) area variances, on property located at same, to install a 28’x 18’x 23’ high accessory structure, whereas accessory structures of 121 square feet or greater shall not exceed 15 feet height and whereas detached accessory structures shall be located to the rear of the front building line of the principal building pursuant to Chapter 300-28 F (4) (b) and Chapter 300-59 B (1) and Chapter 300-59 A (1) respectively in an R-1 Residential District. Tax Acct. #131.01-1-56

11. Appeal of Robert and Kamia McCullough, 794 Stony Point Road, Spencerport, NY 14559 for two (2) area variances, on property located at same to install 185 linear feet of 6’ tall, closed construction fence, whereas, fences shall not exceed four feet in height in side and rear yards and any fence in a residential district shall be of open and permanent construction, pursuant to Chapter 300- 50 A (8) (a) and Chapter 300-50 B (1) respectively in an R-1 Residential District. Tax Acct. #116.03-1-10
