Champaign County Board Litigation Committee met February 6

Champaign County Board Litigation Committee met Feb. 6.

Here is the minutes provided by the committee:

I. Call to Order

Committee Chair Rosales called the meeting to order at 4:31 p.m.

II. Roll Call

A verbal roll call was taken, and a quorum was declared present.

III. Approval of Agenda/Addenda

MOTION by Mr. Clifford to approve the agenda; seconded by Mr. Thorsland. Upon vote, the MOTION CARRIED unanimously.

IV. Approval of Minutes

A. Open Session – November 7, 2019

MOTION by Mr. Thorsland to approve the open session minutes of November 7, 2019; seconded by Mr. Clifford. Upon vote, the MOTION CARRIED unanimously.

V. Public Participation

None

VI. Closed Session Pursuant to 5 ILCS 120/2(c)(11) to consider litigation which is pending against or on behalf of Champaign County, and litigation that is probable or imminent against Champaign County

MOTION by Mr. Clifford to enter into CLOSED session pursuant to 5 ILCS 120/2(c)(11) to consider litigation which is pending against or on behalf of Champaign County, and litigation that is probable or imminent against Champaign County and that the following parties remain present: Assistant State’s Attorney, Legal Counsel, County Executive, Chief Deputy of Finance and recording secretary; seconded by Mr. Thorsland.

Roll call vote: Aye: 4 – Clifford, Stohr, Thorsland, Rosales 

Nay: 0 

MOTION CARRIED unanimously

The Litigation Committee entered Closed Session at 4:34 p.m.

The Litigation Committee resumed Open Session at 5:22 p.m.

VII. Other Business

A. Closed Session – November 7, 2019

MOTION by Mr. Thorsland to approve the closed session minutes of November 7, 2019; seconded by Mr. Clifford. Upon vote, the MOTION CARRIED unanimously.

A question was brought forward during closed session regarding how much authority the Committee has before a request needs to go to the County Board. Ms. Ogden explained that there is not a formal agreement of what the Committee has the authority to authorize in regard to settlement amounts. Everyone agrees that the County Board has delegated the Litigation Committee to make the decision regarding legal matters.

VIII. Adjournment

Committee Chair Rosales adjourned the meeting at 5:27 p.m.
