Village of Ogden Zoning Board of Appeals will meet on Thursday, Feb. 7.

Here is the agenda provided by the board:

II. OLD BUSINESS:

1. Appeal of Borrego Solar Systems Inc. for a conditional use permit to construct a 18.1 megawatt large scale solar energy system on three (3) parcels owned by Raymond Stein, Jr. and Scott Mallon located at 2645, 2648, and 2675 Union Street, Spencerport, NY 14559, whereas, this may be permitted upon obtaining a conditional use permit from the Zoning Board of Appeals, after first obtaining Town Board approval and Planning Board site plan approval, pursuant to Chapter 300-38 I in a SESO Solar Energy Systems Overlay District. Tax Acct. #’s 117.01-1-1, 116.02-1-7, and 116.02-1-13.11

III. PUBLIC HEARING NEW BUSINESS:

2. Appeal of John Urlaub of Rohrbach’s, 3859 Buffalo Road, Rochester, NY 14624, for a Special Use Permit and three (3) area variances to install a commercial sign, which is 18 square feet, and 13’ high and closer to the lot line than six (6) feet, on property located at same, whereas, each commercial enterprise shall be permitted to install said sign upon obtaining a permit by the Zoning Board of Appeals and whereas, each sign shall not exceed six square feet in size, and shall not project more than six feet in height above grade, and such signs shall not be nearer than six feet to any lot line, respectively pursuant to Chapter 224-8 A and Chapter 224-8 D (1) in a Light Industrial District. Tax Acct. #132.02-2-6

3. Appeal of Todd Falbo, 4040 Buffalo Road, Rochester, NY 14624, for an area variance on property located at same, to allow a side setback for a garage addition of 7 ft., whereas, the minimum side setback required is 15 feet pursuant to Chapter 300-28 F (1)(e) in an R-1 Residential District. Tax Acct. #132.01-2-22

4. Appeal of Michelle & Michael Laraby, 2918 Union Street, Rochester, NY 14624, for two (2) area variances to install approximately 274 linear feet of 6’high, closed construction fence, whereas, fences shall not exceed four feet in height in side and rear yards and any fence in a residential district shall be of open and permanent construction, pursuant to Chapter 300-50 A (8) (a) and Chapter 300-50 B (1) respectively in an R-1 Residential District. Tax Acct. #116.04-2-25

5. Appeal of Erik & Courtney Crandall, 4273 Canal Road, Spencerport, NY 14559, for an area variance on property located at same, to construct a 37’ x 24’ addition to existing home which is pre-existing, non- conforming for front setback, whereas, principal buildings shall be not less than 60 feet from the street right of way line, pursuant to Chapter 300-28 F (1) (d) in an R-1 Residential District. Tax Acct. #085.02- 3-5.1

6. Appeal of David Franco, 58 Thistlewood Circle, Spencerport, NY 14559, to obtain a Home Occupation Permit with one (1) variance to breed tropical fish using 480 square feet of property, on property located at same, whereas, this shall be permitted upon obtaining permission from the Zoning Board of Appeals, and whereas, not more than 25% of the floor area of the dwelling is devoted to such home occupation which is 427 square feet for this property, respectively pursuant to Chapter 300-54 and Chapter 300-54 C (5) in an R-1 Residential District. Tax Acct. # 087.01-3-29
