1. Appeal of James Gizzi, 10 Regency Oaks Blvd., Rochester, NY 14624, for five (5) area variances to construct a selfstorage facility, on property located at same, with a front setback of 51 feet from Buffalo Road, whereas, 100 feet is required; with a side setback of 25ft from south property line, whereas, 30 feet is required; with a lot area of 56,192 square feet, whereas, 62,500 square feet is required; with a lot width of 130 feet wide, whereas, 250 feet is required; and a five (5) feet setback to parking lot, whereas 25 feet is required, pursuant to Chapter 210-34 J (4)(b), Chapter 210-34 J (6), Chapter 210-34 J (1), 210-34 J (2), 210-34 J (5) respectively in a Light Industrial District. 2. Appeal of Andy Rueby & Marlene Balys, 26 Pirates Cove, Spencerport, NY 14559, for an area variance to allow a three season room within the rear setback at a distance from lot line of approximately 7.5’, on property located at same, whereas, principal buildings shall not be less than 20 feet from the rear lot line, pursuant to Chapter 210-35.1 C (3) c [2][e][iii] in a SC Senior Citizen District. Tax Acct. #087.15-1-65.1

3. Appeal of Anthony & Carol Fusilli, 26 Osage Trail, Spencerport, NY 14559, for an area variance on property located at same, to construct an 8’ x 36’overhang on the 24’ x 36’ pole barn for a total of 1152 square feet, whereas, no accessory building(s) may exceed 600 square feet total, pursuant to Chapter 210-28 F (3) (b) in a R-1 Residential District. Tax Acct. #115.04-2-35.1

4. Appeal of Karen McLaughlin, 681 Gillett Road, Spencerport, NY 14559, for two (2) area variances on property located at same, to construct a 30’ x 40’x 16’(1200 sq. ft.) pole barn, whereas, the maximum sq. ft. allowed for an accessory building is 1%, which on this parcel equals 307 sq. ft. and whereas, no accessory structure of 121 square feet or greater shall exceed 15 feet height, respectively pursuant to Chapter 210-28 F (3)(b) and Chapter 210-54 B (1) in a R-1 Residential District. Tax Acct. #117.01-2-4

5. Appeal of Timothy Pahuta II, 47 Colby Street, Spencerport, NY 14559, for an area variance to park a 38’3” camper on property located at same, whereas, campers having an overall length of 35 feet or less may be parked on private property, pursuant to Chapter 210-77 C in an R-1 Residential District. Tax Acct. #101.02-2-16

6. Appeal of Amy Muniga, 226 Whittier Road, Rochester NY 14624, for two (2) area variances to allow an existing fence of approximately 80 linear feet of 6’ high, solid construction fence and approximately 72 linear feet of 4’ high, solid construction fence, on property located at same, whereas, fences shall not exceed four feet in height in side and rear yards and any fence in a residential district shall be of open and permanent construction, pursuant to Chapter 210-47 A (8) (a) and Chapter 210-47 B (1) respectively in an R-1 Residential District. Tax Acct#117.03-2-1

7. Appeal of Helen MacConnell of Route 259 Family Restaurant, 2139 Union Street, Spencerport, NY 14559, for a Special Sign Permit to install a commercial sign between Suites 11 & 12, which is 36” x 85”on property located at same, and one (1) sign change on monument sign, whereas each separate commercial or industrial enterprise shall be permitted to install, upon obtaining a permit from the Zoning Board of Appeals, a single sign mounted or placed on the front of a building, pursuant to Chapter 157-8 A in a General Commercial District. Tax Acct. #087.05-8-1
