1. Appeal of Louie Bivone, 4809 Lyell Road, Spencerport, NY 14559, for three (3) area variances on property located at same, one (1) to construct a garage having a total square footage of 1,206 sq. ft., whereas, single-family residences are allowed garage space not to exceed 960 square feet; and two (2) to construct a 7,760 square feet, 28’ tall accessory building, on property located at same, whereas, no accessory building(s) may exceed 600 square feet total, and whereas, no accessory structure of 121 square feet or greater shall exceed 15 feet height, respectively pursuant to Chapter 210-28 C (2), Chapter 210-28 F (3)(b) and Chapter 210-54 B (1) in an R-1 Residential District. Tax Acct #102.04- 2-5

2. Appeal of Gary Coia, 4403 Canal Road, Spencerport, NY 14559, for an area variance on property located at same, to construct a 24’ x 36’ (864 sq. ft.) accessory building, whereas, no accessory building(s) may exceed 600 square feet total floor area per parcel, regardless of lot size, pursuant to Chapter 210-28 F(3) (b) in an R-1 Residential District. Tax Acct. #085.02-4-4.22

3. Appeal of Dennis & Kathleen Kelly, 272 Gillett Road, Spencerport, NY 14559, for a conditional use permit with one (1) area variance to allow an in-law apartment with no common area, on property located at same, whereas, this shall be permitted upon obtaining permission from the Zoning Board of Appeals, and whereas, a common access area shall be provided, pursuant to Chapter 210-28 D (9) and Chapter 210-28 D (9) (b) respectively in an R-1 Residential District. Tax Acct. #087.04-2-2

4. Appeal of Chris LaForest, 70 Forest Meadow Trail, Rochester, NY 14624, for a conditional use permit with one (1) area variance for an existing 1,000 square foot in-law apartment, on property located at same, whereas, this is permitted subject to the issuance of a conditional use permit by the Zoning Board of Appeals and whereas, square footage shall not exceed 750 square feet, pursuant to Chapter 210-28 D (9) in an R-1 Residential District. Tax Acct #117.04-2-78
