City of Danville City Council met December 19. 

Here is the minutes as provided by the council:

#1...The Regular Meeting of the City Council of the City of Danville was called to order at 6:00 p.m. by Mayor Scott Eisenhauer at the Robert E. Jones Municipal Building, 17 W. Main Street, Danville, Illinois.


        The Roll Call was answered by Mayor Scott Eisenhauer, Vice Mayor Brenda Brown, Aldermen Jon Cooper, R.J. Davis, Dan Duncheon, Steve Foster, Steve Nichols, Michael O'Kane, Michael Puhr, and Lloyd Randle, and Rick Strebing. Absent were Aldermen Sharon McMahon, Sherry Pickering, Tom Stone, and Rickey Williams, Jr. A quorum was present.

Staff Members Present: Budget Director Gayle Lewis, City Clerk Lisa Monson, City Comptroller Shelley Scott, Corporation Counsel Dave Wesner, Engineering & Urban Services Manager David Schnelle, Urban Services Senior Planner Tyson Terhune, Human Relations Administrator Sandra Finch, Public Safety Director Larry Thomason, Public Transportation Director Lisa Beith, and Public Works Deputy Director Ray Garcia.

There were also 12 audience members and 3 news media in attendance.

#2...Invocation was given by Vice Mayor Brown, followed by 

#3...The Pledge of Allegiance led by Lance Corporal Michael J. Courson, United States Marine Corps.

#4...The Minutes of the regular meeting held, December 5, 2017, having been published and distributed, were presented. Alderman Cooper moved for approval as presented, seconded by Alderman Davis. On the voice vote, the motion so ordered

#5...The Agenda for the evening was presented. Alderman Cooper moved for approval as presented, seconded by Vice Mayor Brown. On the voice vote, all ayes, no nays; the motion so ordered.

#6-B...Board/Committee

Appointments – None 

#6-C...Reports of Boards, Agencies, Commissions Alderman Foster presented a report on behalf of the Vermilion Regional Airport Authority Board. The board voted to go ahead with the air show, but they chose to take a year off for better planning of the air show for the year 2019.

#6-D...Items of Information 

#6-D-1...Acceptance of Audit for Fiscal Year 2016-2017 Vice Mayor Brown moved for approval, seconded by Alderman Duncheon. On the voice vote, all ayes, no nays; the motion so ordered.

#6-D-2...Presentation of Award for Historic Preservation Tyson Terhune, Senior Planner announced the City of Danville was chosen from one of two municipalities in Illinois with certified local governments to win in the public outreach and education award category from the Illinois Association of Historic Preservation (IAHPC). The Historic Preservation Commission focused on education by creating a web presence on the City's website, creating Danville trivia cards with 110 questions on Danville history that went out to five or six restaurants, and creating Geocaches around town, a scavenger hunt using GPS and Smartphones.

Other Items of Information

• Mayor Eisenhauer announced the City Hall Christmas Luncheon will be held Wednesday, December 20th at 12:00 p.m. and all Aldermen are invited to attend. 

• The Policemen's Benevolent & Protective Association Unit 11 (PB&PA #11) Union donated a total of $3,000.00 on December 18th to residents in the Community with Police Officers and Director Thomason pulling over 30 citizens and handing them a $100 bill. The PB&PA #11 has also been serving meals during the holiday season to seniors housed at senior residence centers throughout the City. Mayor Eisenhauer applauded the Police union for providing the meals as well as the donation of $3,000.00 to the citizens. 

• There was a demonstration today at Fire Station Number 3 from Presence Regional EMS demonstrating a new mannequin donated to the Mobile Education Lab by Presence Health Foundation and the Julius W. Hegeler || Foundation. The mannequin is a technologically advanced dummy capable of simulating injury that will benefit firefighters and paramedics in training.

• The December 27, 2017 Public Services Committee meeting will be cancelled.

• Mayor Eisenhauer wished everyone a “Merry Christmas” and “Happy New Year”.

#7...Petitions, Communications, Audience Comments 

Robb Dietzen of Danville spoke in opposition to consider contracting out grass and vegetation services for Danville Public Works and feels it would not be justifiable to the taxpayers.

#9...Payroll 

Mayor Eisenhauer presented Payrolls for December 8, 2017, of $662,433.15, and for December 15, 2017, of $65,695.70. Alderman Cooper moved to dispense with the readings and asked for approval as presented, seconded by Alderman Strebing. There being no questions, the roll call vote being: 

Ayes: Aldermen Brown, Duncheon, Davis, Strebing, O'Kane, Randle, Cooper, Puhr, Nichols, Foster

Nays: None 

Absent: Aldermen McMahon, Pickering, Stone, Williams

Motion carried 10 to 0 with 4 absent.

#10...Schedule of Vouchers Payable 

Mayor Eisenhauer presented the Schedule of Vouchers Payable, having been published, posted, and distributed, for regular run of December 12, 2017, of $426,707.54, for special run of December 12, 2017, of $16,573.33, and for December 19, 2017 of $2,272,047.25. Alderman Strebing moved to dispense with the readings and asked for approval as presented, seconded by Alderman Cooper. After all questions were addressed, the roll call vote being: 

Ayes: Aldermen Duncheon, Davis, Strebing, O'Kane, Randle, Cooper, Puhr, Nichols, Foster, Brown 

Nays: None 

Absent: Aldermen McMahon, Pickering, Stone, Williams

#11... Public Works Committee Report

#11-A...Chairman Puhr presented RESOLUTION NO. 2017-127 amending a Contract for Asbestos Abatement Phase Il at 520 Chandler Street (former Lincoln School), Bid 588, to increase the amount to Shemel-Tarillion Inc. in the amount of $27,280.00 for a total overall contract and purchase order amount of $87,460.00, moved to dispense with the reading and asked for approval as recommended by Committee, seconded by Alderman Cooper. After all questions were addressed, the roll call vote being: 

Ayes: Aldermen Duncheon, Davis, Strebing, O'Kane, Cooper, Puhr, Nichols, Foster, Brown

Nays: Alderman Randle 

Absent: Aldermen McMahon, Pickering, Stone, Williams 

Motion carried 9 to 1 with 4 absent

#11-B...Chairman Puhr presented RESOLUTION NO. 2017-128 authorizing Consideration of Contracting for Grass and Vegetation Management Services for Danville Public Works, in accordance with Article 14 of the Collective Bargaining Agreement with Laborer's International-Local #703 be provided formal notice, of the City's desire to enter Contracts with private vendors for mowing, cutting, trimming, chemical applications, and related maintenance activities of city parks, public properties and roadside right-of-ways. as an Alderman request to revisit the resolution, moved to dispense with the reading and asked for approval as recommended by Committee, seconded by Alderman Cooper. Mayor Eisenhauer explained the point of order, according to Roberts Rules of Order, as to why this is being brought back as an agenda item. Anytime someone votes in the majority, but wishes to have that decision revisited by the same body, they have the ability to do so by asking the Chair to bring that item back to the floor. This was at the request of an Alderman who did vote in the majority on that evening. Alderman Strebing explained he asked that the item be brought back as he thought the laborers would like to go ahead and look at it as a possible way to save money city-wide and we do not know unless this is approved so that is why he changed his mind and viewpoint. He also feels there are better uses for the City for some of the Laborers in the Streets and Sewers instead of mowing in the Parks. Alderman Duncheon feels looking at the contracting could not hurt either way. Alderman Foster will be supporting the resolution. Alderman Randle will not be supporting the resolution due to the Laborers in negotiations right now and interfering with negotiations is not a good place to be in. After all questions were addressed and there being no further discussion, the roll call vote being: 

Ayes: Aldermen Strebing, O'Kane, Cooper, Puhr, Nichols, Foster, Brown, Duncheon 

Nays: Aldermen Randle, Davis 

Absent: Aldermen McMahon, Pickering, Stone, Williams

Motion carried 8 to 2 with 4 absent.

#11-C...Chairman Puhr presented RESOLUTION NO. 2017-129 adopting an ADA Transition Plan, moved to dispense with the reading and asked for approval as recommended by Committee, seconded by Alderman Cooper. There being no questions or discussion, the roll call vote being: 

Ayes: Aldermen O'Kane, Randle, Cooper, Puhr, Nichols, Foster, Brown, Duncheon, Davis, Strebing 

Nays: None 

Absent: Aldermen McMahon, Pickering, Stone, Williams

Motion carried 10 to 0 with 4 absent.

#11-D...Chairman Puhr presented RESOLUTION NO. 2017-130 authorizing Agreement with ICC (Illinois Commerce Commission) for a Roadway Crossing Safety Improvement on Griffin Street (AAR/DOT #3573715W, railroad milepost OZA-123-86) highway-rail grade crossing of CSX Transportation's (CSX) tracks, moved to dispense with the reading and asked for approval as recommended by Committee, seconded by Alderman Cooper. After all questions were addressed and there being no further discussion, the roll call vote being: 

Ayes: Aldermen Randle, Cooper, Puhr, Nichols, Foster, Brown, Duncheon, Davis, Strebing, O'Kane 

Nays: None 

Absent: Aldermen McMahon, Pickering, Stone, Williams

#11-E...Chairman Puhr presented RESOLUTION NO. 2017-131 appropriating Motor Fuel Tax Funds for the City portions of the State of Illinois projects, local Section Numbers 12-00347-00-PV (East Main Street) in the amount of $22,280.71 and 16-00351-00-RS (Lynch Road), in the amount of $11,996.32, moved to dispense with the reading and asked for approval as recommended by Committee, seconded by Alderman Strebing. There being no questions or discussion, the roll call vote being: 

Ayes: Aldermen Cooper, Puhr, Nichols, Foster, Brown, Duncheon, Davis, Strebing, O'Kane, Randle 

Nays: None 

Absent: Aldermen McMahon, Pickering, Stone, Williams

#11-F...Chairman Puhr presented RESOLUTION NO. 2017-132 amending an Engineering Agreement with Clark Dietz Inc. for Koehn Creek Sanitary Sewer Interceptor Repair for an additional amount of $16,300.00 for a total project amount of $87,850.00, with the work to be paid from the Sanitary Sewer Fund-Engineering Services budget, moved to dispense with the reading and asked for approval as recommended by Committee, seconded by Alderman Cooper. After all questions were addressed and there being no further discussion, the roll call vote being: 

Ayes: Aldermen Puhr, Nichols, Foster, Brown, Duncheon, Davis, Strebing, O'Kane, Randle, Cooper 

Nays: None 

Absent: Aldermen McMahon, Pickering, Stone, Williams

Chairman Nichols wished everyone a “Merry Christmas". 

[The December 27, 2017 Public Services Committee Meeting has been cancelled. The next meeting will be held January 23, 2018 at 6:00 p.m.]

#14... Items of Information

• Vice Mayor Brown spoke concern of complaints she has received pertaining to the condition of the railroad tracks on Williams Street as someone started to repair part of the tracks in 2016 and the current conditions are horrible when crossing the tracks. Director Schnelle stated he will contact the railroad and the Illinois Commerce Commission.

• Vice Mayor Brown attended Doc. Ashton and the Root Canals concert Sunday evening at St. James United Methodist Church and thought it was very entertaining. She praised Director Schnelle and his daughter for their musical talents during the concert. Director Schnelle stated there was over $1,000.00 contributed to the food pantry that evening.

#15...Adjournment There being no further business to discuss, the meeting was adjourned by acclamation at 6:54 p.m. following a motion by Alderman Strebing and a second by Alderman Puhr.
