1. We have been very busy with school taxes. We have been busy with

hunting season as well.

1. Three basic items that kept me busy and they are the three items on the

agenda, the approval of the application of solar energy systems overlay

district, to set a public hearing for Delaware River Solar and to authorize the

Deputy Supervisor to sign a partial release of drainage easement with

concerning property at 16 Rex Lane.

                                                     Approving Application of the

                                                          Solar Energy Systems

                                                      Overlay District Regulations

WHEREAS, Abundant Solar Power Inc. has made application

to the Town Board of the Town of Ogden for approval and authorization for

the application of the Solar Energy Systems Overlay District Regulations to

a parcel of land located within the Town of Ogden, Monroe County, New

York which they wish to develop for installation of a solar energy system;

and

WHEREAS, the Town Board of the Town of Ogden did hold

and conduct a public hearing to consider such application, which public

hearing was held at the Ogden Community Center, 269 Ogden Center Road,

Spencerport, New York on the 13th day of September, 2017 at 7:00 p.m. and

at which hearing all interested persons were heard concerning the subject

matter thereof, due notice of which was given as required by law; and

WHEREAS, upon a review of the map, plan and application

and after having heard all interested persons concerning such application and

due deliberation having been had, the Town Board of the Town of Ogden is

desirous of approving such application;

NOW, THEREFORE, BE IT RESOLVED by the Town

Board of the Town of Ogden, Monroe County, New York, as follows:

SECTION I: That by the adoption of this Resolution and Final Order, the

Town Board of the Town of Ogden does hereby approve the application of

the Solar Energy Systems Overlay District Regulations to that parcel of land,

as more particularly described in the application of Abundant Solar Power,

Inc. which is now on file in the Town of Ogden offices.

SECTION II: That the Planning Board of the Town of Ogden shall be

entitled to apply such Solar Energy Systems Overlay District Regulations to

the application of Abundant Solar Power for site plan approval in

accordance with the provisions of such Overlay District, as more particularly

described therein.

SECTION III: That the Planning Board of the Town of Ogden, acting as

lead agency for purposes of SEQR Review did, at its July 13, 2017 regular

meeting, issue its determination and finding that the proposed action will

have no significant impact upon the environment, and did issue its negative

declaration with respect to the same.

SECTION IV: That the Town Clerk shall give due notice of this

Resolution and Final Order as required by law.

Scheduling Public Hearing for Application of Solar Energy Systems

Overlay District

WHEREAS, Delaware River Solar, LLC has made application

to the Town Board of the Town of Ogden, to allow for the application of the

Solar Energy Systems Overlay District regulations to certain lands located

within the Town of Ogden, Monroe County, New York, as more fully

described in such application presently on file with the Town Clerk’s Office;

and

WHEREAS, it is necessary for the Town Board to hold and

conduct a public hearing to consider such application and to hear all

interested persons concerning the subject matter thereof;

NOW, THEREFORE, BE IT RESOLVED by the Town

Board of the Town of Ogden, Monroe County, New York, as follows:

SECTION I: That the Town Board of the Town of Ogden shall hold and

conduct a public hearing to consider the application of the Solar Energy

Systems Overlay District to certain lands located within the Town of Ogden,

Monroe County, New York, as such lands are more particularly bounded and

described as follows:

south of the centerline intersection of Colby Street and Washington Street,

thence easterly on a line bearing S 89°30'47" E, a distance of 33.00 feet to a

point on the east line of Washington Street, said point being the point of

Such public hearing will be held and conducted by the Town Board of

the Town of Ogden at the Ogden Community Center, 269 Ogden Center

Road, Spencerport, NY 14559 on the 25th day of October, 2017 at 7:30 p.m.

and at which hearing all interested persons shall be heard concerning the

subject matter thereof.

SECTION II: That the Town Clerk will give due legal notice of this public

hearing by publication and posting as required by law.

WHEREAS, the Town of Ogden did heretofore secure a

certain Stormwater Drainage Easement with Terence E. Burns and Kimberly

A. Closson, residing at 16 Rex Lane, Spencerport, NY 14559 (hereinafter

referred to as the “Owners”); and such easement is recorded in the Monroe

County Clerk’s Office in Liber 8337 of Deeds, at page 680, which

stormwater drainage easement effects the lands of the Owners; and

WHEREAS, the Owners have requested that the Town of

Ogden release a portion of the drainage easement above referenced; and

WHEREAS, the Town Highway Superintendent has reviewed

the requested partial release and has recommended the same; now therefore;

BE IT RESOLVED, that Thomas Cole, Deputy Supervisor be

and he hereby is authorized to execute a Partial Release of Drainage

Easement effecting the property at 16 Rex Lane, Spencerport, New York in

form and content as approved by the Town Attorney and Town

Superintendent of Highways.
