The Village of Mahomet Board of Trustees met, Tuesday August 22, 2017 at 6:00 p.m. at the Village of Mahomet
Administrative Offices, 503 E. Main St., Mahomet, IL.
Members Present: Bruce Colravy, David Johnson, Andy Harpst, Donald Lynn, Bill Oliger and Brian

Call to Order:
Pledge of Allegiance/Roll Call
President Widener called the meeting to order at 6:00 p.m. After the Pledge of Allegiance, Roll Call was taken and a quorum was present.

OTHER ORDINANCES, RESOLUTIONS AND MOTIONS (TO BE ACTED UPON)
Widener revised the agenda order in order to allow Heckman to attend her 2nd graders Back to School Night.
RESOLUTION 17-08-03, A RESOLUTION CONCERNING THE CONSTRUCTION PLANS FOR HUNTERS RIDGE PHASE 4:
Heckman stated this item had not been presented at a Study Session, but documents were prepared faster than
they anticipated and the developer would like to get started as soon as possible.
She stated the proposed Fourth phase is consistent with the proposed Preliminary Plat also under consideration.
She added that Phase Four will result in seven (7) new single family housing lots (RU zoning), one (1) multi-
family lot (R3 zoning) planned for eight (8) townhome units, a detention basin along Oak Street (U.S. Route 150), and the construction of Cates Drive (formerly Commercial Drive) from Timber Wolf Lane to just north of
Hunters Ridge Court.
Construction of Cates Drive from Oak Street to Timberwolf Lane which was a deferred improvement from a prior
phase will be constructed as part of this phase.
She reviewed the requested waivers as follows:
1. Waive the standard requirement for half-street improvements for the portion of U.S. Route 150 that is
adjacent to the subdivision.
2. Waive the current ordinance requirements for stormwater detention to allow the proposed stormwater
detention to adhere to the previous ordinance requirements when the subdivision was first designed.
3. Waive the requirements for a cul-de-sac or a temporary turnaround at the north end of Cates Drive. The
temporary dead-end street is only 150 feet long and only affects two single family homes. The new
connection to Hunters Ridge Court will provide an outlet for any through traffic.
4. Waive the requirement to allow the pond normal water surface elevation to be lowered by 3 feet.
Trustees discussed the waivers, in particular # 2 and #4 asking for clarification concerning the impact this would
have on standing water. Heckman and Brown stated the outside consultant working on this was very picky about
stormwater and would never have agreed to this if it was going to create issues in the future.
Widener stated changing street names has always been a pet peeve of his and asked if the Village controls
street names. He stated the name does not seem to fit the area.
Heckman stated now that the commercial was no longer planned for that area Commercial Drive did not pertain
and the developer wanted to change the name to Cates Drive.
Heckman stated staff had always made sure street names did not conflict with Village or County, but could
suggest something else.
Widener asked Colravy his experience in his “former life” as a UPS driver and confusion caused by street
names. Colravy stated there are places in Champaign where you cross the street and the name changes.
Heckman stated having Route 150 dividing the street does help make a clear division between the streets.
METZGER MOVED, HARPST SECONDED, “RESOLUTION 17-08-03, A RESOLUTION CONCERNING THE

ORDINANCE 17-08-02, AN ORDINANCE REGULATING THE OPERATION OF DIRT-BIKES AND GO-KARTS
ON PRIVATE PROPERTY IN RESIDENTIAL ZONES:
Widener stated this issue had been discussed last week at the Study Session and staff had been instructed to
make some revisions to address concerns from the Trustees. Brown reviewed the changes that were made
stating that the definition of residential area had been deleted and a new definition of dwelling had been added
that was consistent with the current Zoning Ordinance.
Brown noted that the distance issue had been address by prohibiting the riding of the subject vehicles within 300
ft. of a dwelling. This would allow those residents with larger lots to still be able to ride these vehicles on their
property and reduce the noise to their neighbors as suggested by Trustee Metzger.
Lynn stated a resident who lives along the tracks by the treatment plant and he uses his 4-wheeler to plow his
driveway was concerned he would no longer be able to use it. Brown stated he would still be able to plow or
mow or whatever as this was addressed in the Ordinance as an exclusion.
Evans explained that the definition of dwelling had not originally be included in the ordinance but in order to
provide the measurement something had to be used as a starting point for the measurement. He noted that
“dwelling” had already been defined in the current Zoning Ordinance so it was included in the final version.
Widener reiterated what Chief Metzler had said at the Study Session which was that the enforcement of this
ordinance would be on a complaint basis. He stated this ordinance now gives the Police something they can
enforce. Brown stated there have been more and more comments made recently about people driving these on
the streets as well.
Widener opened the floor for comments from the public. James Feller, 903 Penny Lane, stated he had lived in
Mahomet for 32 years, long enough to remember cattle in Oak Creek and miniature horses in Sandy Ridge. He
noted that he had moved here from Hensley Township and wanted his kids to go to Mahomet Schools as they
are the best around.
He said he was moving out of Mahomet in 2-3 weeks and the house would be for sale. He stated his reason for
moving was 50% because of this reason. He stated he has tolerated this type of noise from his neighbor. He
stated as soon as the son gets home from school at 11:00 a.m. he starts riding his ATVs. He stated they don’t
have just one they have 4. He stated they don’t even get a break from them on Sundays. He finally talked to his
neighbor and asked them not to start them up before 10:00 a.m. on Sunday mornings.
He stated he is sure the other neighbors hear it too. He said he never called the police even though the noise
would last until 10-11 at night.
He added that they are always working on them, tuning them up in the garage which just amplifies the noise and
reverberates with the noise travelling to his house.
He talked to his neighbor before the meeting and told him this ordinance was being considered and the neighbor
said he didn’t care and would do whatever he wanted on his own property.
He said he won’t be affected by this since he’s moving but wanted the Board to know just how annoying these
things can be and hoped the Board would take a strong stand on the ordinance. He added he would have
stayed in Mahomet forever and feels forced out partially by the noise. He provided the address of his neighbor
for the Chief’s record.
He noted they even run them in the snow, just not as much.
He wanted to the Board to know he was not venting toward them just venting.
Widener thanked him for his comments and apologized he had to go through with it and stated the Village cannot
address issues if they are not made aware of them.
Johnson stated wanted to know what this ordinance does that our current ordinance didn’t do and asked if this
ordinance was redundant.
Evans stated Jim stated it was not redundant as it addresses this type of activity directly which was not
addressed in the current noise ordinance.
Widener stated the main purpose of the current noise ordinance was to regulate construction type work in
residential areas but did not address the type of noise caused by off road type vehicles.
Johnson asked if there were a lot of complaints. Metzler stated the department does get complaints from various
areas, not every day, but they do come in. Johnson asked how these issues had been handled previously.
Metzler stated by “asking nicely”. Metzler added that sometimes they do wander out of their properties onto the
streets. There being no additional comments, LYNN MOVED, HARPST SECONDED, “ORDINANCE 17-08-

Mayor’s Report:
September 2017 Board and Study Session Meeting Calendar
:Widener stated the September 2017 Study Sessions are scheduled for September 12 and 19 at 6:00 p.m. The
September Board meeting would be held September 26 at 6:00 p.m.
Widener asked if there any known absences so far for the September meeting. Metzger stated he would be
absent on Sept. 12th
.Widener reminded everyone of the Sangamon River Music Festival this weekend and that volunteers were still
needed and the signup website was very user friendly. He stated good weather was expected for both days.
Widener stated he wanted to take a moment to recognize and congratulate Attorney Jim Evans on his 80th
birthday.
A cake and beverages was provided after the lighting of the candles and singing Happy Birthday.
New Business:
Colravy thanked Widener and Metzger for helping sell ducks at the booth and for Lynn stopping by. He noted
ducks are still for sale and they have had a good response to duck sales.
