II. Public Hearing Old Business:

1. Appeal of Viktor Yakimov for property at 67 Ogden Parma Townline Road, Spencerport, NY 14559, for one (1) area variance on property located at same, to construct a 40’ x 24’ (960 sq. ft.) accessory building, whereas, no accessory building may exceed 600 square feet total floor area per parcel, regardless of lot size, pursuant to Chapter 210-28 F (3) (b) in an R-1 Residential District. Tax Acct #102.03-2-2

2. Appeal of Matthew & Kathleen Brady, 1255 Vroom Road, Spencerport, NY 14559, for three (3) area variances on property located at same, to install a swimming pool with a front setback at a distance of 50’, whereas, swimming pools shall be not less than 60 feet from the front lot line, pursuant to Chapter 179-2 in an R-1 Residential District. And to install 296 linear feet of 6’ high, solid construction fence, whereas, fences shall not exceed four feet in height in side and rear yards and any fence in a residential district shall be of open and permanent construction, pursuant to Chapter 210-47 A (8) (a) and Chapter 210-47 B (1) respectively in an R-1 Residential District. III. Public Hearing New Business:

1. Appeal of Leslie & Joanne Beardslee, 906 Washington Street, Spencerport, NY 14559, for two (2) area variances on property located at same; one (1) to construct a 28’ x 40’ x 20’ high (1120 sq. ft.) accessory building in addition to an existing accessory building of 150 sq. ft. accessory building for a total of 1,270 sq. ft., whereas, no accessory building(s) may exceed 600 square feet total floor area per parcel, regardless of lot size, and one (1) variance for accessory structures of 121 square feet or greater shall not exceed 15 feet height, respectively pursuant to Chapter 210-28 F(3) (b) and Chapter 210-54 B (1) in an R-1 Residential District. Tax Acct. #100.04-2-4

2. Appeal of Megan & Steven Cavuoto, 9 Blackburn Knoll, Spencerport, NY 14559, for an area variance to install approximately 527 linear feet of 4 1/2” tall, open construction fence, at property located at same, whereas, fences shall not exceed three feet in height in front yards, nor shall they exceed four feet in height in side and rear yards; pursuant to Chapter 210-47 A (8) (a) in a R-1 Residential District. Tax Acct. #085.04-2-10.1

3. Appeal of Laurie Curts and James Walsh, 1171 Ogden Parma Town Line Road, Spencerport, NY 14559, for an area variance to construct a 16’ x 20’ (320 sq. ft.) accessory building on property located at same, whereas, the maximum land coverage by accessory buildings allowable is 1%, which on this lot would equal 233 sq. ft., pursuant to Chapter 210-28 F (3) (b) in an R-1 Residential District. Tax Id #085.02-1-3

4. Appeal of Stephen & Kristine Cocilova, 21 Brower Road, Spencerport, NY 14559, for three (3) area variances to allow a pre-existing 6’tall, solid construction privacy fence located in the front yard, at property located at same, whereas, fences shall not exceed three feet in the height in front yard, nor shall any fence be of closed construction; pursuant to Chapter 210-47 A (8) (a) and Chapter 210-47 B (1) in a R-1 Residential District. Tax Acct. #117.01-1-13.1

5. Appeal of Marlene Reynolds, for property at 51 Ashland Oaks, Spencerport, NY 14559, for a Conditional Use permit for a proposed in-law apartment to be built at the same time as the primary residence, on property located at same, whereas, this is permitted subject to the issuance of a conditional use permit by the Zoning Board of Appeals, pursuant to Chapter 210-28 D (9) in an R-1 Residential District. Tax Id#087.01-5-21

6. Appeal of Marlene & Andy Rueby, 26 Pirates Cove, Spencerport, NY 14559, for an area variance to allow a deck within the rear setback at a distance from lot line of approximately 2.7’, on property located at same, whereas, principal buildings shall not be less than 20 feet from the rear lot line, pursuant to Chapter 210-35.1 C (3) c [2][e][iii] in a SC Senior Citizen District. Tax Acct. #087.15-1-65.1

7. Appeal of Sara Blosenhauer & Michael Fischer for an area variance to construct a garage having a total square footage of 1,119 sq. ft. on property located at 24 Shelly Lane, Spencerport, NY 14559, whereas, single-family residences are allowed garage space not to exceed 960 square feet, pursuant to Chapter 210-28 C (2) in an R-1 Residential District. Tax Acct #086.01-2-17.124
