Village of Mahomet Plan and Zoning Commission met November 6.

Call to Order: The Plan and Zoning Commission called the meeting to order at 7 pm on Tuesday November 6, 2018.
Roll Call:
Members Present: Jay Roloff, Steve Briney, Bob Buchanan, Mike Buzicky, Robert DeAtley, Damian Spencer, and Earl Seamands.
Members Absent: None
Others Present: Community Development Director Kelly Pfeifer; Planner Abby Heckman, Village Attorney Joe Chamley, and Mayor Sean Widner
Public Comment: No one came forward to speak.
Review/Approve Minutes: September 4, 2018
Kelly Pfeifer stated that since the minutes were just passed out the PZC could move approval to the next meeting.
Briney moved to move review and approval of the September 4, 2018 minutes to the next meeting. Buchanan seconded the motion. ROLL CALL. ALL YES. Motion Passed.
Public Hearings:
CU2018‐04: BANKCO OVERHEAD DOOR
A RESOLUTION CONCERNING A CONDITIONAL USE PERMIT TO ALLOW MIXED USE COMMERCIAL ON 9.41± ACRES OF LAND ZONED C‐2 GENERAL COMMERCIAL, COMMONLY KNOWN AS 214 S LAKE OF THE WOODS ROAD, MAHOMET IL (KEVIN MCCLURE AND RYAN MCCLURE OWNER/PETITIONER)
Mr. Roloff explained the public hearing process to members of the audience.
Abby Heckman presented details of the case and stated that a drainage plan was submitted and approved for the site.
Kevin McClure, applicant and property owner, stated that staff’s presentation correctly summed up what they are trying to do on the site. He stated they want to clean the place up and, in the future, may want to ask for the ability to build storage units on the site.
Abby Heckman clarified that the storage unit use was not included in this conditional use permit request and they would have to come back before the PZC to amend their request in the future to allow that use. An amendment would require another public hearing.
Mr. Roloff stated the request only includes the outdoor vehicle storage use, the woodcutting use, and their existing overhead door business.
Mr. Roloff stated it was time for the public to come forward to speak.
Paul Sahni, 116 Karadan Drive, asked for clarification about the uses that will operate on the site.
Abby Heckman stated staff is aware that the Masons have been operating on the site, so staff told the property owner to apply for the conditional use permit to allow multiple uses on the site. The Bankco business is an allowed principle use on the site and any additional principle uses require conditional use permit approval. There are three uses proposed on the site; the Bankco business, the woodcutting, and the outdoor storage of vehicles.
Paul Sahni asked how the vehicle parking would work and would people be staying in the RVs.
Kevin McClure stated they are only proposing storage of vehicles because there is a need in the community and no one would live there. There is no electricity or facilities so only storage of vehicles.
Brian Metzger, 203 Ranch Lane, asked if there is to be more dirt hauled in.
Kevin McClure stated there would be more dirt brought in to meet the elevations shown on the approved drainage plan.
Kelly Pfeifer explained the approved grading plan.
Brian Metzger asked how much dirt will be brought to the site and when it would be completed.
Kevin McClure stated he didn’t know the amount of dirt but Stark Construction is in communication with his engineer Bryan Bradshaw.
Brian Metzger asked if the dirt work will be done by spring.
Kevin McClure stated yes and that he hoped it would be done within two months.
Brian Metzger asked about the location of the woodcutting.
Kevin McClure stated they plan to move the woodcutting from its current location to where it is shown on the plan.
Brian Metzger stated the planted trees are close to the fence and he was concerned about future maintenance.
Kevin McClure stated the trees were planted 7 feet from the property line.
Abby Heckman asked for clarification of the distance from the east property line to the woodcutting area.
Ryan McClure stated a minimum of 25 feet setback from the east property line for the woodcutting use area.
Michael Daab, 2004 Appaloosa Lane, with the Forrest Preserve District stated they were concerned about runoff and siltation from the site into Elks Lake.
Kevin McClure stated that erosion control is shown on the approved drainage plan.
Michael Daab asked who is responsible for ensuring compliance with the erosion control.
Kevin McClure stated Stark Construction is doing the earth work.
Abby Heckman stated the Village would monitor the drainage work based on the approved plan.
Kelly Pfeifer stated that ultimately the property owner is responsible for compliance. The site has a stormwater permit to do the work shown on the approved plan and if there is a problem the Village goes to the property owner and can stop work on the project. They also had to file a stormwater pollution prevention plan with the State.
Michael Daab stated he was glad to see silt fencing on the plan.
Kelly Pfeifer stated the silt fencing would likely be in place for a while until ground cover is stable and appropriate to remove the silt fencing.
Michael Daab asked if there would be maintenance of vehicles on the site.
Kevin McClure stated no and that vehicles would just be pulled in and out for storage.
Mr. Roloff asked if there was anyone else that wanted to speak and seeing no one he would entertain a motion to close the public hearing.
Buchanan moved to close the public hearing for CU2018‐04: BANKCO OVERHEAD DOORS. Buzicky seconded the motion. ROLL CALL. ALL YES. Motion Passed.
ORDINANCES, RESOLUTIONS and MOTIONS (TO BE ACTED UPON):

Kelly Pfeifer stated staff has not provided a resolution and is treating this as a preliminary discussion so that staff can draft a resolution for presentation at the next meeting based on direction from the PZC. She stated that staff wanted to go ahead with the public hearing to get public input prior to drafting the resolution. She went over Conditional Use permits and conditions that could be appropriate.
Mr. Seamands asked about parking and screening requirements.
Kelly Pfeifer stated those items can be conditions that can then be enforced.
The Commission and staff discussed natural buffering and maintenance of screening plantings.
Kevin McClure stated the trees that have been planted are Black Hills Spruce and will be replaced if they die.
Abby Heckman went over the details in the staff memo.
Mr. Briney asked if he was done planting trees.
Kevin McClure stated yes and there are also established trees along the interstate and Village property.
Mr. Buchanan stated he thought the area shown for the outdoor vehicle storage was not large enough for 50 vehicles.
Kevin McClure stated they would look at the size before they come back to the next meeting.
Mr. Buchanan asked what ground surface they would use for the outdoor vehicle storage. He thought the surface should be dust free.
Kevin McClure stated he thought it would be oil and chip.
Abby Heckman stated that the zoning ordinance requires a dust free surface.
Mr. Buzicky asked the petitioner to put the use areas on the site plan prepared by BKB Engineering.
Kevin McClure stated he would have BKB add those to the site plan.
Abby Heckman asked the petitioner if he plans to light the vehicle storage area.
Kevin McClure stated he didn’t want to encroach on the neighbors.
Abby Heckman stated that if lighting is a concern staff recommends restricting the height of the light pole since shielded fixtures are already required in the zoning ordinance.
Brian Metzger stated he was not concerned with the lighting because of where the vehicle storage is placed on the property.
The Commission discussed with staff possible restrictions on the uses allowed on the site.
Abby Heckman stated a Conditional Use Permit stays with the property not the applicant.
Mr. DeAtley discussed the location of Bankco parking, dumpster, and business trailer parking with the
petitioner. He stated he was concerned about the proximity to the residential properties. He asked the
petitioner the size of the planted trees.
Kevin McClure stated they were three to five feet tall.
Mr. DeAtley stated he looked up Black Hill Spruce trees for the benefit of the audience and that they typically grow 15 to 20 feet in width. Mr. DeAtley discussed the drainage plan and stated the state fines people for not complying with the stormwater pollution prevention plan. He stated he was not concerned about the lighting since the zoning ordinance addresses the fixtures and because of the location of the use on the site.
The PZC, Kevin McClure, and staff discussed the drainage plan.
Mr. Briney stated he would like to see a fence against the residential area and he was concerned about people accessing the trailers and equipment used for the Bankco business.
The PZC and staff discussed the location of the trailer equipment parking and possible fencing.
Mr. Roloff went over the topics discussed.
Mr. DeAtley asked the petitioner about the number of employees for his busniess.
Kevin McClure stated they have three employees including him and his son.
Mr. Roloff stated that if there is no more discussion he would entertain a motion to table this case until the next meeting.
Buzicky moved to TABLE the conditional use permit for CU2018‐04: BANKCO OVERHEAD DOOR until the next PZC meeting. Spencer seconded the motion. ROLL CALL. ALL YES. Motion Passed.
The PZC discussed how long the property has been commercially used.
The PZC and staff discussed the lack of buffering requirements in the zoning ordinance and the possible
exploration of including requirements in the ordinance.
RIDGE CREEK FOURTH SUBDIVISION (FINAL PLAT)
A RESOLUTION CONCERNING A FINAL PLAT FOR 17 RESIDENTIAL LOTS ON 5.019± ACRES OF LAND GENERALLY LOCATED APPROXIMATLEY 120 FEET NORTH OF SLADE LANE AT SWEET GRASS LANE, MAHOMET IL. (UNLIMITED HOLDING, LLC ‐ ROB FRERICHS OWNER/PETITIONER)
Abby Heckman and Kelly Pfeifer presented details of the case.
The PZC and staff discussed the stormwater drainage for the plat.
Spencer moved to APPROVE the final plat for RIDGE CREEK FOURTH SUBDIVISION with the stated findings of fact. DeAtley seconded the motion. ROLL CALL. ALL YES. Motion Passed.
BE IT THEREFORE RESOLVED this 6th day of November, 2018, by the Plan and Zoning Commission of the Village of Mahomet, that:
A. The Plan and Zoning Commission does hereby recommend APPROVAL of the Final Plat for the Ridge Creek Fourth Subdivision upon completion of modifications identified by the Village staff and does hereby authorize the Chairman to sign the said Final Plat upon completion of said modifications.
B. The approval of the Final Plat recommended above is further subject to the following conditions:
1. Submission of all supporting documentation in proper form
2. The approval of the Final Plat recommended above is further subject to the review and approval of the Final Plat and supporting documents as applicable by other relevant agencies and utility service providers.
3. In the event that the modifications to the Final Plat are not completed, the outside agency reviews are not completed, all supporting documents are not submitted in final form, or the conditions set forth above are not met within sixty (60) days from the date of approval by the Board of Trustees, the approvals recommended herein shall be null and void.
MAP2017‐03: HUNTERS RIDGE FIFTH SUBDIVISION (FINAL PLAT)
A RESOLUTION CONCERNING A FINAL PLAT FOR 22 RESIDENTIAL LOTS ON 7.031± ACRES OF LAND GENERALLY LOCATED APPROXIMATLEY 315 FEET NORTH OF OAK STREET AND NORTHWEST OF CATES DRIVE, MAHOMET IL. (HR5, LLC ‐ ROB FRERICHS OWNER/PETITIONER)
Abby Heckman presented details of the case.
The PZC and staff discussed the stormwater drainage for the plat.
DeAtley moved to APPROVE the final plat for MAP2017‐03: HUNTERS RIDGE FIFTH SUBDIVISION with the stated findings of fact. Buchanan seconded the motion. ROLL CALL. ALL YES. Motion Passed.

Commissioner Comments
PROPOSED 2019 PZC MEETING SCHEDULE (DISCUSSION ONLY)
Abby Heckman stated the PZC does not need to make a motion about the schedule, but staff wanted the PZC to have an opportunity to comment on the schedule prior to presentation to the BOT.
There were no comments about the schedule.
Mr. Roloff asked if 2019 is expected to be a busy as 2019.
Kelly Pfeifer discussed upcoming plats, construction timing, phasing, and other upcoming cases.
Sean Widner explained the proposed railroad crossing on South Mahomet Road.
