Purpose of the Meeting:

To audit claims, act on monthly reports and remittances, and to transact such other business which may legally come before said meeting.

Swearing in Ceremony for our new Town of Ogden Police Officer Marvin DiPilato:

Supervisor Lenhard: Tonight, I have the pleasure of swearing in Marvin DiPilato. I spent some time with Marvin and he is a very interesting gentleman. For those of you who don’t know, he is replacing the part-time position for Todd Baxter. His resume is extensive and when we talked I found that he has been a lot of places and done a lot of great things. He brings a different personality to the department and I think it is a good one. I am delighted to have you here, please come forward.

Supervisor Lenhard: Would the Chief like to say a few words?

Chief Mears: Thank you members of the Town Board. We are very happy to have Marvin with us; some of us had the pleasure of working with him on the night shift. He is a good man and when we ask for back up and Marvin shows up, we know that we have good backup. He has impressed everyone in the department. He was with Monroe County for 20 years and has 30 years with the Air Force, just a lifetime of service to others. The fact that he has former co-workers here for his swearing in ceremony speaks volumes. We thank his family for coming and allowing us to have him part-time. Congratulations!

Officer DiPilato: Thank you for having me. In the short time I have been here it has been awesome. Thank you for the opportunity.

1. I did go to the meeting chaired by the County Executive. It was amazing, I think that every Supervisor was there so it was good. It lasted almost two hours and we didn’t really come to a conclusion to exactly what we are supposed to do. The State is not very clear, however our County Executive is going forward and looking for us to send her something that would give the County something to work with. I think one of the things we are going to hone in on is the Sewer Districts. That will be of some value to them. 2. I went to the D.A.R.E. Graduation with Chief Mears at Taylor School. It was a combination graduation of a moving up ceremony as well so it was a little lengthy but it was nice.

David H. Widger, Highway Superintendent-

1. We are moving forward with a large culvert replacement on Whittier Road south of Buffalo. All of the utility companies have volunteered to cut their utilities off through our site and then re-establish them when we are done. Whittier Road will be closed south of Buffalo Road to Westside Drive starting the 17th of July for a month.

Noelle M. Burley, Town Clerk-

1. Sarah, my Deputy and I all attended a passport refresher course in Buffalo on Monday. It was nice to meet the people that we talk with and to view the facility to see how passports are processed. We are pretty fortunate to have a Passport Agency so close to home. Usually people have to drive hours to find a facility close to them so we are fortunate that there is one so close.

Supervisor Lenhard: I just want to say that your department is very impressive with helping these people process their passports. People don’t always know what they are in for, but they are prepared because of you all. I am very proud of you. Another thing I would like to mention is the Lions Club donated a flag for Pineway Ponds park and Tony put it up today. It was the most gratifying thing he has ever done, he said. It was very nice and I think the Lions Club will be very happy when they see it.

Whereas, Connie Marianetti has submitted her intent to retire as a Part-time Office Clerk III in the Ogden Police Department, and

Whereas, this retirement will be effective July 28, 2017.

Now, Therefore Be It Resolved that the Town Board of the Town of Ogden does hereby accept, with regret, the retirement of Connie Marianetti effective July 28, 2017.

Resolved, that the Supervisor, Gay H. Lenhard, be and hereby is authorized to sign a Memorandum of Understanding with the New York State Office of Real Property Tax Services in support of the 2018 Reassessment Project for the Town of Ogden.

Resolved, that the Town Board declares as surplus truck parts as follows: engine, transmission, rear axles and dump body, and other miscellaneous parts from the 2005 Sterling Dump Truck Vin # 2FZHAZCV15AV24025 to be disposed of or sold for salvage value at fair market prices. The Highway Superintendent shall obtain fair market value for said parts of this truck from at least two sources before approving of the sale of the parts. All parts will be sold with no warranty either express and/or implied.

Resolution #191-6.28.17-

Introductory Local Law # 5-2017:

Introduced by Councilman Uschold

Seconded by Councilman Perry

Whereas, the Town Board of the Town of Ogden did heretofore hold and conduct a Public Hearing to consider the enactment of Introductory Local Law #5 - 2017; and

Whereas, such Public Hearing was duly held and conducted by the Town Board of the Town of Ogden on the 28th day of June, 2017 at 7:00 p.m. at which hearing, all interested persons were heard concerning the subject matter thereof; and

Whereas, after due consideration, the Town Board believes it would be appropriate to enact such Local Law so as to amend Chapters 157 and 191 of the Code of the Town of Ogden;

Now, Therefore, Be It Resolved by the Town Board of the Town of Ogden, Monroe County, New York, as follows:

Section I: By the adoption of this Resolution, the Town Board does hereby enact Local Law # 5 - 2017 amending Chapter 157 and Chapter 191 of the Code of the Town of Ogden to read and provide as follows:

§157-8 Location and size in commercial and industrial districts.

Each separate commercial or industrial enterprise shall be permitted to erect, upon obtaining a permit from the Zoning Board of Appeals, one or more signs mounted or placed on the front of a building covering no more than a total of 20% of the front wall allocated to such enterprise or 16 square feet, if post mounted.

And to amend Chapter 191 (Towers and Antennas) of the Code as follows:

§191-7 Size and location.-

B(3). If a wind energy conversion system is to be placed on any tower, the minimum work zone distance between the tower base, and a property line or power line is the height of the wind energy system, above ground level, including the blades, plus 10% (i.e. 1.1 times the total height of the wind energy system).

Section II: That the Town Clerk’s shall give due notice of the enactment of this Local Law by the filing of the same with the Secretary of State as required by statute.

Resolution #192-6.28.17-

Whereas, Advantech is proposing to expand and develop an additional part of its property on Buffalo Road; and

Whereas, in conjunction with such development, the Town of Ogden requires that the Developer execute and record in the Monroe County Clerk’s Office a Stormwater Control Facility Maintenance Agreement; and

Whereas, such agreement has been reviewed and approved by Keith O’Toole, Esq., Planning Board Attorney for the Town of Ogden;

Now, Therefore, Be It Resolved by the Town Board of the Town of Ogden, Monroe County, New York, as follows:

Section I: That the Supervisor be and she is hereby authorized to execute the Stormwater Control Facility Maintenance Agreement by and between the Town of Ogden and Emerald Point Developers, LLC.
